         De gemeente Utrecht (hierna: de gemeente) wil 1 raamovereenkomst afsluiten met betrekking tot Constructie All Risks verzekering. De gemeente wil aan 1 inschrijver de opdracht te gunnen. De gemeente gunt de opdracht aan de inschrijver met de economisch meest voordelige inschrijving.

         Deze aanbesteding betreft een Europese aanbesteding volgens de Aanbestedingswet 2012. Hierbij volgt de gemeente een mededingingsprocedure met onderhandeling, hieraan voorafgaand een selectieprocedure. De gemeente kan de overheidsopdracht wegens specifieke omstandigheden die verband houden met de complexiteit en financiële voorwaarden en de daaraan verbonden risico"s, niet gunnen zonder voorafgaande onderhandelingen.

         Het betreft een doorlopende Constructie All Risks verzekering (doorlopende CAR-verzekering) voor de gemeente Utrecht. Een doorlopende CAR-verzekering kan voor gemeente Utrecht niet met een standaard product, c.q. standaard polis gerealiseerd worden. De polis zal namelijk specifiek voor de gemeente opgebouwd moeten worden. In onderhandeling met inschrijvers wil de gemeente een acceptabele polis samenstellen waarbij enerzijds de behoefte voor overdracht van het risico voor de gemeente wordt gerealiseerd en anderzijds wordt gezocht naar een acceptabele verhouding tussen risico-overdracht en premie.
